Lufkin, Texas – A family has filed a wrongful death lawsuit against a Washington-based automotive business over a fatal 2014 motor vehicle accident.
Anderson County residents Lisa Parker, Jerry Starkey, and Jo Ann Starkey are suing Paccar Incorporated individually and as the representatives of the estate of deceased Geoffrey W Parker. They have filed a lawsuit against the company, which is doing its business in Texas, in the United States District Court for the Eastern District of Texas, Lufkin Division. The suit was filed on 7th August. The plaintiffs claim liability and vehicular negligence in the fatal road traffic collision occurred in 2014 April.
The lawsuit states that Geoffrey Parker and Lisa Parker had been residing in Nacogdoches County (TX) when the accident took place. Geoffrey was driving his blue Peterbilt manufactured by defendant Paccar Inc. southbound on United States Hwy 69 in northern Angelina County when a bull came in the lane of travel. According to the suit, the vehicle driven by Parker struck the bull. The accident caused the truck and portions of trailer to jack-knife and separate. The truck was rolled subsequently onto the cab roof, crushing the compartment severely. Geoffrey Parker was killed in the incident. According to the lawsuit, Parker was seated with adequate restraints. However he was suffocated to death as the survival space of the cab experienced substantial intrusion, the lawsuit claims. The incident occurred on 14th April, 2014, court documents show.
Geoffrey’s family members claim that the manufacture and design of the cab was insufficient. The defendants are accused of negligence, strict liability, and gross negligence, in addition to defective manufacture because of an insufficient rollover protection system. Geoffrey Parker’s family is seeking unspecified damages for alleged: pecuniary loss; loss of love, society, companionship and consortium; and emotional distress. The plaintiffs are also seeking punitive damages, pre-judgment interest, post-judgment interest, expenses, costs, and attorney fees.
